The company which owns the web domain https://www.udl.cat is the Universitat de Lleida (hereinafter, UdL), with Tax Identification Number Q-7550001-G and registered address in Plaza de Víctor Siurana, 1, 25003 Lleida (Spain), which performs the public service of higher education through teaching, study and research.

The purpose of the web domain of the UdL is to introduce the services and activities of the University in an up-to-date, truthful and comprehensive manner, at all times guaranteeing accessibility and usability by the users who connect to it.

Pursuant to article 38.2 of Law 40/2015, of 1 October, on the Legal Regime of the Public Sector, only the electronic office (https://seuelectronica.udl.cat/) involves the responsibility of the UdL in relation to the comprehensiveness, truthfulness and updating of the information and the services which can be accessed

The UdL does not accept liability for the third-party websites which can be accessed through the links or for any content made available by third parties.

Any use of a link or access to a third-party website is undertaken at the will and exclusive risk of the users, and the UdL does not recommend or guarantee any information obtained through a link external to the web domain of the UdL and does not accept liability for any loss, claim or damage arising from the use or misuse of a link or from information obtained through it, including other links or other websites; for the interruption of the service or of the access, or for an attempt to use or misuse a link, both on connecting to the website of the UdL and on accessing information from other websites through the website of the UdL.

The UdL shall not accept any liability for the contents, services or products of third parties which can be accessed directly through banners, links, hyperlinks, network or similar from the websites of the UdL, since their inclusion is forbidden without the prior, express and written consent of the UdL.

The UdL reserves the right to make changes to the website, provided that they do not affect the personal data of the users, without prior notice, for the purpose of maintaining its information up to date, adding, modifying, correcting or deleting the contents posted or the design of the portal.

The contents provided by the UdL, in addition to the contents transferred to the Internet through its websites, become a work in the sense of the legislation on intellectual property, and therefore they are protected by the laws and international conventions applicable on this subject.

Any form of reproduction, distribution, public communication, transformation, making available and, in general, any other act of public exploitation referring both to the websites and to their contents and information, is forbidden without the prior express and written consent of the UdL.

The following acts are forbidden: reproduction, distribution, display, transmission, retransmission, broadcast in any form, storage on hardware or software (for example diskettes or computer hard disks), digitization or making available from databases other than those belonging to those authorized by the UdL, in addition to their translation, adaptation, change or any other transformation of these opinions, images, forms, indices and other formal expressions which are made available to the users through the services or contents, when the acts are subject to the applicable legislation in relation to intellectual and industrial property or protection of the image.

Consequently, all the contents which are shown on the different websites mentioned, and especially the designs, texts, graphics, logos, icons, buttons, software, trade names, trademarks, industrial drawings or any other sign subject to industrial and commercial use, are subject to the intellectual and industrial property rights of the UdL, or of third parties owning these rights which have duly authorized the inclusion on the different websites through Creative Commons CC BY.4.0 licences and/or those characteristic of the assigning source, subject to their conditions of use.

The contents, images, forms, opinions, indices and other formal expressions which form part of the websites, in addition to the software necessary for their operation and viewing, also become a work in the sense of copyright and are, therefore, protected by the international conventions and national legislation on intellectual property which are applicable to them. A breach of the same implies serious unlawful acts subject to a penalty under civil and criminal legislation.

Any act is forbidden by means of which the users of the services or contents can exploit or make a commercial use, either directly or indirectly, totally or partially, of any of the contents, images, forms, indices and other formal expressions which form part of the websites of the UdL, without prior and written permission from the UdL.

Any violation of the provisions of this point or of the previous ones shall be considered as an infringement of the legitimate intellectual property rights of the UdL concerning the websites and all of their contents.

Excluded from these restrictions of use is the active advertising information obtained on the transparency Portal of the UdL (https://seuelectronica.udl.cat/transparencia.php), pursuant to Article 4.2.a) of Law 37/2007, of 16 November, on reuse of public sector information (“Reuse of documents made available to the public without being subject to conditions), under the terms and conditions established in these regulations.

Spanish legislation is applicable both to this web domain and to the links for which the UdL is responsible.

Any dispute or discrepancy which arises from the application or interpretation of the terms which make up this legal notice shall be settled in the courts of the city of Lleida (Spain), which shall have exclusive competence above any other jurisdiction.

WEBSITE CONDITIONS OF USE AND PRIVACY POLICY

Access to –and/or use of– this portal owned by the Universitat de Lleida (UdL), from the time when it is accessed, attributes the status of user with the acceptance of the general conditions of use reflected herein. Consequently, the users must carefully read these “Website conditions of use and privacy policy” whenever they access it.

The users of the website of the UdL must access it in accordance with the law, and undertake at all times not to access the website or its contents in a manner contrary to that envisaged and for illicit purposes, detrimental to the rights and freedoms of third parties, or which may damage, deteriorate, saturate or slow down the website, to the detriment of the UdL or of third-party users.

Both access to the websites and the use that may be made of the information and contents that they include shall be the exclusive responsibility of those who do so. The UdL does not accept direct or indirect liabilities for consequential damages or loss of profits, arising from misuse of the services or contents undertaken by the users or third parties.

The UdL is free to limit access to the websites, and to the products and services that are offered on them, in addition to the consequent publication of the opinions, observations, images or comments that the users may send it by e-mail or via the different contact forms.

In this respect the UdL may establish, if it deems this appropriate, without prejudice to the sole and exclusive liability of the users, the filters necessary to prevent contents or opinions from being transferred to the Internet, through its websites, which are considered to be racist, xenophobic, discriminatory, pornographic, defamatory or which, in any way, encourage violence or the dissemination of clearly illegal or harmful contents.

The UdL does not accept liability for the third-party websites which can be accessed through the website by means of links or for any content made available by third parties.

The UdL declines any liability should there be interruptions or a malfunctioning of the services or contents offered on the Internet, whatever the cause. Likewise, the UdL does not accept liability for network outages, losses of information as a result of these outages, temporary power cuts or any other kind of indirect damage which may be caused to the users due to causes external to the UdL.

The UdL does not declare or guarantee that the services or contents are uninterrupted or that they are free from error, that the defects are corrected, or that the service or the server which makes them available are free from viruses or other harmful components, without prejudice to the fact that the UdL strives to avoid this type of incident. Should the user take certain decisions or actions according to the information included on any of the websites, it is recommended to verify the information received with other sources.

Any of the technical, logical or technological resources through which a third party may benefit, directly or indirectly, with or without profit, from each and every one of the contents, forms, indices and other formal expressions which form part of the websites, or from the effort carried out by the UdL for its operation, are forbidden.

In any case, the UdL has implemented adequate security measures for the maintenance of the website, and of its servers, in order to guarantee safe access free from malware.

The UdL only accepts liability for the contents and for the management of the websites of which it is the owner, or on which it has a right of a similar nature. Any other website or social media or repository of information on the Internet, apart from this website, is the liability of its owners and, therefore, once it is accessed, the user shall be subject to the policies that each service has established.

The UdL ordinarily uses different applications, social media and other virtual environments, and always recommends to all users that, before accessing these web environments, they should carefully read the corresponding legal notices and privacy policies, and that they should only access them once they have verified and accepted this legal text in its entirety.

The UdL undertakes to control the contents that are posted in these virtual environments, and shall prevent or block access to the account of the UdL by users who make an incorrect use of them.

For use of social media or browsing in web environments, the UdL recommends, following the instructions of the data protection authorities, the implementation of the following actions:

  • All users are recommended to resort to the use of pseudonyms or personal nicks to operate on the Internet, allowing them to have a true “digital identity” which does not endanger the security of their personal and professional life.
  • Users are recommended to take special care on posting audiovisual and graphic contents on their profiles, since in this case they may be jeopardizing the privacy and intimacy of people close to them.
  • It is recommended to review and read, both prior to user registration and subsequently, the general conditions of use and the privacy policy that the platform makes available on its websites.
  • It is recommended to adequately set up the degree of privacy of the user profile on the social media, in such a way that it is not completely public, but rather the information posted on the profile can only be accessed by those people who have previously been classified by the user as “friends” or “direct contacts”.
  • It is recommended to accept as a contact only those people who are known or with whom some previous relationship exists; not to compulsively accept all contact requests which are received and to investigate, if appropriate, the identity of the person who requests contact.
  • It is recommended not to post, on the user profile, physical contact information which allows any person to know where you live, work or study daily or the leisure facilities that you visit.
  • Users of microblog tools are recommended to take special care in relation to posting information concerning the places where they are located at any given moment.
  • It is recommended to use and post only contents for which you have the essential intellectual property rights. Otherwise, the user will be committing a civil wrong protected by the courts.
  • Users are recommended to use different usernames and passwords to enter the different social media of which they are members.
  • It is recommended to use passwords with a minimum length of 8 alphanumeric characters and with the use of capitals and lowercase letters.
  • All users are recommended to have duly updated antivirus software installed on their hardware.
  • Minors should not disclose excessive personal data. Data must never be provided to strangers.
  • All of the information referring to the website must be read. This information sets out who the owners are and the purpose for which the data are requested.
  • If the users are under fourteen years old, the consent of the parents or guardians is also necessary. The parents or guardians must especially be asked for their decision on the subscription whenever data are requested by social media.
  • The username and password must not be communicated to third parties, and these data must not be shared with friends or classmates. These data are private and must not be communicated to third parties and/or strangers.

Registration of organizations or companies and students with the external placement platform of the UdL.

The legal bases for the processing carried out and described in the previous point are as follows:

  1. The explicit consent granted by the person on accepting the conditions of use and privacy policy in relation to the different services which require it.
  2. The mandatory nature of the processing in relation to the need to perform a contract (labour, academic, agreement, etc.) between the two parties.
  3. The mandatory nature of the processing in fulfilment of any legal obligation which may exist.
  4. The mandatory nature of the processing to satisfy the legitimate interests pursued by the UdL.

Failure to accept this (mandatory) privacy policy shall give rise to the impossibility to carry out the management of the services and/or actions undertaken by the individual. In this case, no type of processing shall be carried out.

We retain the user data provided in accordance with the following criteria:

  1. In those instances of processing in which the purpose does not expire, the data shall be retained for as long as the users do not exercise their rights of deletion or opposition and/or revoke the explicit consent provided.
  1. In accordance with the periods established in the regulations.
  1. Until the time barring of the legal actions which may arise.

In any case, the data shall be destroyed under the terms and conditions foreseen in the regulations on retention and deletion of administrative documents of the UdL and the documentary assessment tables approved by the Generalitat of Catalonia (http://www.udl.cat/ca/serveis/arxiu/archivo/).

The UdL may communicate the personal data to third parties in the following cases:

  • Suppliers which provide services to the UdL. The UdL has signed the corresponding contract or addendum for the commissioning of the processing with each of the suppliers which collaborate with the UdL in order to ensure that their personal data are processed pursuant to the applicable regulations.
  • Entities and/or collaborators of the UdL which participate in a processing purpose described in this policy and for which the users have provided their personal data.
  • In those cases in which there is a legal obligation to communicate the data.

The users may access their data at any time; request their rectification, deletion or portability; oppose their processing, and request the limitation of the processing, provided that this is compatible with the purposes described, by means of a written message sent to the address dpd@udl.cat.

They may also make a claim addressed to the Catalan Data Protection Authority, through its electronic office (https://seu.apd.cat) or by non-electronic means.

In principle, the data always come from the data subjects. In the event of receiving a communication from the UdL and not being aware of having provided your data, it is possible that a third party has taken your status or identity. In this case, kindly notify us using the means provided in this privacy policy.

In this respect, the users are liable for the authenticity of the data provided, ensuring that they are accurate, current and complete for the purpose for which they are provided, and accept liability for damages, both for loss of profit and for consequential damages, which may arise from these inaccuracies or untruths. In any case, if the data provided on the corresponding forms are owned by a third party, the users become the sole parties responsible for obtaining their consent correctly and for providing them with the information on the aspects reflected in this legal notice and privacy policy.

The data will only be used to manage the response to your application, in accordance with the message text.

The UdL is lawfully entitled to process these data if you give your consent and as long as you do not withdraw your application.
